Can a Physician Assistant Baker Act a patient?

The Council, at a meeting held August 9, 2007 and the Board of Medicine at its August 11, 2007 meeting, reaffirmed the position that Physician Assistant’s may Baker Act patients as this is considered the practice of medicine. The Florida Department of Children and Families asserts that there is no statutory authority in Chapter 394, F.S., for physician assistants to execute a certificate for an involuntary examination. Dispensing PA’s
HB 1007 passed during the 2007 Legislative Session and amends s. 458.347, F.S. and s. 459.022, F.S. This amendment allows physician assistants to dispense non-controlled substances in accordance with his supervising physician’s dispensing privileges. There is no fee to register and at this time, there are no forms to complete. The Council is reviewing changes to the Supervision Data Form so please stay tuned to the web page for more information. In the meantime, please send a letter with the following information if you will be dispensing:
• Physician Assistant’s name and license number
• Supervising physician’s name for which the PA is dispensing and his/her specialty area

ATTN: PRESCRIBING PRACTITIONERS - Change in Law - Effective July 1, 2003, SB 2084 provides the following:
 
Section 1. Section 456.42, Florida Statutes, is created to read: 456.42 Written prescriptions for medicinal drugs.--A written prescription for a medicinal drug issued by a health care practitioner licensed by law to prescribe such drug must be legibly printed or typed so as to be capable of being understood by the pharmacist filling the prescription; must contain the name of the prescribing practitioner, the name and strength of the drug prescribed, the quantity of the drug prescribed in both textual and numerical formats, and the directions for use of the drug; must be dated with the month written out in textual letters; and must be signed by the prescribing practitioner on the day when issued.

The Federation of State Medical Boards provides primary source verification of Physician Assistant’s credentials, which is acceptable by the Florida Council on Physician Assistants.
