Can a Physician Assistant Baker Act a patient?
The Council, at a meeting held August 9, 2007 and the Board of Medicine at its August 11, 2007 meeting, reaffirmed the position that Physician Assistant’s may Baker Act patients as this is considered the practice of medicine. The Florida Department of Children and Families asserts that there is no statutory authority in Chapter 394, F.S., for physician assistants to execute a certificate for an involuntary examination. Physician assistants must attain this authority through affirmative action of the legislature. For more discussion see: http://www.dcf.state.fl.us/mentalhealth/laws/index.shtml
