HB 587-Relating to Health Care Practitioners/Licensees:

All health care licensees must provide notice to patients of what type of license the health care provider has (e.g., Medical Doctor, Dietitian/nutritionist, Nutrition Counselor, Dentist, ARNP, Physician Assistant, Dentist, etc):

  • A name tag meets the requirement,
  • An oral notice to patient meets the requirement,
  • Advertisement must include this notice as well,
  • Exemptions apply to Chapter 394, 395, and 400 facilities, and
  • Boards may promulgate rules to further define compliance with the statute.

Changes to CE Requirements - On June 20, 2006 Governor Bush signed HB 699 into law. It takes effect on July 1, 2006. Below is a summary of the portions of the bill regarding CE requirements.

The new law provides that dietitians/nutritionists and nutritional counselors (NDs and NCs) will now only be required to complete a continuing education course on HIV/AIDS – which must be done prior to the first renewal of the license. Once the licensee has taken that course, he or she does not ever have to take it again, unless the law changes. Most Florida licensed dietitian/nutritionists and nutrition counselors have already met this requirement and will not need to take the course again.

The HIV/AIDS course will no longer be required prior to initial licensure. For initial licensure, the only requirement will be two (2) credits in Prevention of Medical Errors. The biennial requirement for Prevention of Medical Errors also remains the same –NDs and NCs must complete two (2) credits during each two-year licensure cycle.

End of life and palliative care courses can no longer be used in lieu of the HIV/AIDS course.

Section 456.033, F.S., does not exempt a licensee from the requirement included in Section 381.0035 (pdf - 15kb), Florida Statutes for HIV/AIDS education.

Below is a summary of Florida CE requirements for ND’s and NCs, effective July 1, 2006:

or licenses expiring May 31, 2007

If initially licensed from June 1, 2005 to May 31, 2006:

30 hours total, with specifics as follows:
3 hours on HIV/AIDS
2 hours on the prevention of medical errors
Up to 15 hours may be in home study
No more than 10 hours may be in management, risk management, personal growth, and educational techniques.
The licensee shall retain the certificates of attendance or other records for 4 years for documentation purposes, in
case of audit.

If initially licensed from June 1, 2006 to January 1, 2007:
3 hours on HIV/AIDS
2 hours on the prevention of medical errors

For licenses expiring May 31, 2009

If initially licensed from January 2, 2007 to May 31, 2008:

30 hours total, with specifics as follows:
3 hours on HIV/AIDS
2 hours on the prevention of medical errors
Up to 15 hours may be in home study
No more than 10 hours may be in management, risk management, personal growth, and educational techniques.
The licensee shall retain the certificates of attendance or other records for 4 years for documentation purposes, in case of audit.

Every Renewal Thereafter

30 hours total, with specifics as follows:
2 hours on the prevention of medical errors
Up to 15 hours may be in home study
No more than 10 hours may be in management, risk management, personal growth, and educational techniques.
The licensee shall retain the certificates of attendance or other records for 4 years for documentation purposes, in case of audit.

Recent Rule Revisions:

NEW! CE Broker Information for Providers and Licensees - Licensees may subscribe now and receive the personal benefits of continuing education tracking through May 31, 2007. The renewal of your license will be affected by continuing education tracking through the CE Broker system beginning with the June 1, 2005 through May 31, 2007 licensure cycle.

Effective December 5, 2003, all applicants must complete the required 2-hour course on the prevention of medical errors prior to initial licensure.
