About Drug, Device and Cosmetic Regulation

Drugs, Devices & Cosmetics, is responsible for regulating and enforcing The Florida Drug and Cosmetic Act, Chapter 499 Florida Statutes. The purpose of this law is intended to safeguard public health and protect consumers from injury and merchandising deceit involving drugs, medical devices, and cosmetics. This act provides for regulatory oversight of the manufacture and distribution of drugs, devices, cosmetics, and ether within and into Florida.

Drugs, Devices & Cosmetics serves a vital function in ensuring drug, device, and cosmetic quality and safety. Drugs, Devices & Cosmetics works very closely with the federal agencies such as the FDA and DEA, as well as many state and local regulatory and law enforcement agencies.

One of the primary functions of Drugs, Devices & Cosmetics is to ensure the integrity of Florida's prescription drug supply by following drugs from their manufacture, through wholesale channels, to pharmacies and ultimately to the patient. The U.S. Congress enacted the 1987 Prescription Drug Marketing Act which mandates state regulation of the drug distribution market because pharmaceuticals, including prescription drug samples, which have been mislabeled, misbranded, improperly stored or shipped, have exceeded their expiration dates, or are outright counterfeits have been injected into the national (and international) distribution system in astonishing numbers.
